Are Weight Loss Products FSA/HSA Eligible?

Weight loss products are typically not eligible for reimbursement with a Flexible Spending Account (FSA) or Health Savings Account (HSA). However, in specific cases, certain products may qualify with a Letter of Medical Necessity (LMN) if prescribed to treat a diagnosed medical condition such as obesity, hypertension, or heart disease.

Why Are Weight Loss Products Not FSA/HSA Eligible?

Most weight loss products are marketed for general health, fitness, or appearance, not for the treatment of a medical condition. Under IRS Code Section 213(d), medical expenses must be primarily for diagnosing, treating, or preventing a disease.

According to IRS Publication 502, “You can’t include the cost of diet food or beverages” because these items are considered substitutes for normal nutrition. Therefore, over-the-counter weight loss products—including meal replacements, herbal supplements, and appetite suppressants—do not qualify as eligible expenses unless they are specifically prescribed for a medical condition.

What’s Not Covered?

  • Over-the-counter weight loss pills or appetite suppressants

  • Protein shakes, meal replacement bars, or powders

  • Herbal and detox teas marketed for weight loss

  • Fitness-related supplements or fat burners

  • Weight loss programs focused on appearance or general wellness

LMN and Exceptions

Some weight loss products or programs may qualify if they are prescribed to treat a specific diagnosed medical condition such as obesity, diabetes, or hypertension. In these cases, reimbursement may be possible if:

  • The expense is primarily for medical care, not general health; and

  • The treatment is prescribed and documented by a licensed medical provider.

Examples that may qualify with proper documentation:

  • Prescription-only weight loss medications (e.g., Wegovy, Ozempic, Contrave)

  • Physician-prescribed nutritional replacements used under medical supervision

  • Medically supervised weight management programs

To pursue reimbursement:

  1. Obtain a physician’s diagnosis and a Letter of Medical Necessity (LMN) specifying the condition being treated and the product or program recommended.

  2. Submit the LMN along with itemized receipts to your FSA/HSA administrator.

  3. Retain all documentation, including prescriptions and physician notes, for your records.

Without an LMN, all over-the-counter or cosmetic weight loss products remain ineligible for reimbursement.
