Is Maternity Clothing FSA/HSA Eligible?

Maternity clothing is not eligible for reimbursement with a Flexible Spending Account (FSA) or Health Savings Account (HSA).

Why Is Maternity Clothing Not FSA/HSA Eligible?

Maternity clothing is considered a personal expense rather than a medical one. While these garments provide comfort and accommodate physical changes during pregnancy, they are not used to diagnose, treat, or prevent a medical condition, and therefore do not qualify as medical care under IRS Code Section 213(d).


According to IRS Publication 502, expenses that are primarily for personal use or general health are not reimbursable, even when related to pregnancy. Clothing, in particular, is explicitly excluded from eligible medical expenses unless it serves a specific medical function and is not worn for everyday use.

What’s Not Covered?

  • Standard maternity wear (dresses, jeans, tops, or leggings)

  • Nursing bras, postpartum shapewear, and maternity support belts not prescribed by a physician

  • Compression garments designed for comfort or support during pregnancy

  • Any maternity item purchased for general comfort or fit

LMN and Exceptions

Maternity clothing is not eligible under normal circumstances, even with a Letter of Medical Necessity (LMN).


However, a few rare exceptions may apply if the item serves a clear medical function, such as:

  • Medical-grade maternity compression stockings prescribed to treat pregnancy-related swelling, varicose veins, or circulatory issues.

  • Support garments specifically designed and prescribed to relieve pain from a diagnosed back, pelvic, or musculoskeletal condition related to pregnancy.

To pursue reimbursement for medically necessary compression or support wear:

  1. Obtain a physician’s diagnosis and prescription.

  2. Request a Letter of Medical Necessity (LMN) detailing the medical condition and purpose of the garment.

  3. Submit the LMN to your FSA/HSA administrator before purchase.

  4. Retain your receipts and documentation for verification.

Everyday maternity clothing remains ineligible, even if recommended for comfort during pregnancy.
